1. This Policy
This Policy outlines Scholearn’s expectations of Tutors who carry out tuition sessions via the Scholearn platform. We reserve the right to modify this Statement at any time without notice by posting the changes on this page.
2. Tutor Status and Responsibilities
2.1 Tutors are not employees of Scholearn and are solely responsible for their own actions both on and off the Website.
2.2 Tutors must be at least 18 years old.
2.3 Tutors must be legally entitled (possessing the relevant immigration status) to work in the UK on a self-employed basis.
2.4 If Tutors contact Students who are under 18, they must ensure that these Students are represented by a parent or legal guardian who gives consent for the Student to receive tuition.
2.5 Tutors are responsible for ensuring that the personal information they provide and their personal statements on the Website are accurate and in no way misleading. They must update this information promptly to maintain its accuracy and relevance.
2.6 Tutors are expected to disclose any criminal convictions or cautions they may have to Scholearn, including any criminal convictions or cautions received at any time after having registered a Tutor account on the Website and for as long as the Tutor remains registered with Scholearn.
2.7 Any Tutor who, in Scholearn’s reasonable opinion, fails to comply with this Policy may be immediately suspended from using the Website and related services. Scholearn reserves the rights to cancel any existing Bookings at any time in such circumstances.
2.8 Tutors must use their own judgement about whether they wish to offer their tuition services to a Student. Tutors must take every precaution to ensure they work in a safe environment and are responsible for taking out and maintaining their own insurance policies to cover the work they undertake.
2.9 Tutors are responsible for notifying Scholearn when they qualify to move up their Tutor Fee.
2.10 Tutors should carry out their tutoring services in a professional manner, with due skill, diligence and care.
2.11 Tutors are responsible for the content of lessons. These are to be carried out with proper preparation in accordance with a particular course of study, and in accordance with the Client’s instructions and/or relevant exam syllabus.
2.12 Although Scholearn may have some teaching resources and may be able to support Tutors by providing suitable materials, Tutors should be aware that they are responsible for providing all reasonable teaching materials. Tutors may qualify for a discretionary payment relating to the creation of teaching materials. Further information can be found in section 5.5 of this Policy.
2.13 Tutors are expected to be responsive when contacted by Scholearn. If a Tutor persistently fails to respond to communication from Scholearn (via email or telephone or both), then we reserve the right to withdraw your services from the Scholearn platform.
2.14 Tutors are expected to make Bookings for Lessons and respond to messages received from Scholearn and Users promptly.
2.15 Tutors must only make Bookings for Lessons in accordance with the instructions of their Students. If Tutors make Bookings for additional Lessons which they fail to deliver, they will be liable to refund the Student directly of any Tutor Fee they have received for any such Bookings.
2.16 Tutors are expected to allow for up to 15 minutes following the scheduled start time of a Lesson for Students to attend. During this time, Tutors should contact Students and must be able to evidence this. If Tutors fail to do so, they will be liable to refund the Student of any Tutor Fee they have received for the relevant booking.
2.17 Tutors must not complete or intend to complete coursework, or any similar assignments, on behalf of Students.
2.18 Tutors must ensure that all written communication with Students to organise Bookings and arrange Lessons takes place via the Website or via email as provided by the parent / guardian of the Student.
2.19 Tutors shall indemnify Scholearn for all claims and liabilities arising out of any use by the Tutor of the Website, including any costs and expenses incurred.
2.20 Tutors are responsible for ensuring that they have the correct equipment to be able to access the Online Classroom prior to an Online Lesson. Tutors will be liable to refund any fees received for an Online Lesson in the event that they are unable to access the Online Classroom for whatever reason, unless in the instance that this is a result of Scholearn’s Website or that of the third party Online Classroom being unavailable due to maintenance purposes.
2.21 Tutors acknowledge and agree to recordings being shared with students.
2.22 Tutors acknowledge that work available via the Scholearn platform is likely to fluctuate by season and therefore understand that work may not always be available.
3. Tax
3.1 As a Tutor, you are expected to duly and promptly pay all income tax and national insurance contributions in relation to all charges and sums payable to the Tutor by the Company and shall be responsible for completing and submitting all relevant assessments, returns and other information to HM Revenue & Customs in relation to such charges and sums and to taxation affairs generally.
3.2 The Tutor shall indemnify the Company and keep the Company fully and effectively indemnified against all income tax, national insurance contributions and related penalties and/or interest in respect of any charges paid or payable by the Company to the Tutor for the tuition, and any reasonable costs incurred by the Company in recovering any such sum due by the Tutor to the Company under this paragraph.
4. Private Arrangements
4.1 In consideration of Scholearn providing you with Students, you are not permitted to make private arrangements for tuition with Clients introduced by Scholearn or with new Clients introduced by Scholearn. Should you breach this obligation, you will be liable to account to Scholearn, all sums received by you from the Client/new Client without deduction and Scholearn shall be entitled to obtain an injunction against you to prevent further breaches. This obligation shall continue not withstanding termination or completion or other discharge of this Agreement.
4.2 Any work referred to a Tutor by a Client of Scholearn must be billed through Scholearn on your behalf. Scholearn is willing to negotiate on commission for new Clients referred to you by our Client but Scholearn must process the billing and bookings must be through Scholearn.
4.3 The Tutor will not provide or agree to provide any services or carry out any work for the Client or the Student other than the tuition.
5. Payment
5.1 Scholearn will agree the fee structure with the Client and this may not be changed by the Tutor or the Client without written authority/consent of Scholearn.
5.2 Scholearn collects fees due from Students/Clients and passes them onto you following deductions i.e. Platform Fee. Payment to Tutors will take place on the last Friday of every month. Payments will only be made after payment has been received from the Client.
5.3 Tutors will not be paid directly from the Client. You will not be entitled to receive your fee until Scholearn has received payment from the Client. If Scholearn does not receive payment in reasonable time, Tutors may obtain written permission from Scholearn to invoice the Client directly.
5.4 Tutors must not accept any payment direct from the Client without written permission from Scholearn. Should you do so, all sums received by you will be immediately payable to Scholearn and shall be actionable through the Courts without further notice to you.
5.5 Tutors may be entitled to an additional payment from Scholearn for their contribution to educational resources, including worksheets and revision packs. This payment is at the discretion of Scholearn and will be paid on an ad hoc basis.
5.6 Tutors may be entitled to an additional payment from Scholearn for their contribution to marketing materials, including TikTok videos, Instagram posts and other social media related activity. This payment is at the discretion of Scholearn and will be paid on an ad hoc basis.
6. Cancellations
6.1 Tutors may cancel a Booking at any time prior to a Lesson taking place. To do so, Tutors must inform the Student directly via the Website or the email of the parent / guardian of the student provided to Scholearn and cancel the Booking on the Website. In the event of a Tutor cancelling a Booking, the Student will not be charged any Lesson Fee or, if the Student has paid the Lesson Fee, they will receive a full refund.
6.2 Bookings cannot be cancelled after the Lesson has started.
7. Child Protection
7.1 Scholearn seeks to provide the best service possible and provide a safe experience in which Students can learn.
7.2 All Tutors must comply with The Tutors’ Association Child Protection Policy, whether or not they are a member of the Tutor’s Association, and all relevant legislation and government guidance.
7.3 If any User has a concern regarding child protection, they should contact Scholearn immediately.
7.4 Scholearn’s designated Child Protection Lead is Charlotte Ingham.
8. Confidentiality
8.1 The Tutor undertakes that they will not at any time during or after the conclusion of this agreement, disclose to any person any confidential information concerning Scholearn, its affairs, customers, clients, or suppliers of Scholearn, except that you may disclose Scholearn’s confidential information as may be required by the law, court order, or any governmental or regulatory authority.
8.2 The Tutor undertakes not to make use of confidential information encountered through association with Scholearn for any purpose other than to perform your obligations as part of this Policy.
9. Data Protection Act
9.1 Scholearn uses Tutor data for the purposes of the services that it provides. Tutors providing personal data consent to the use of that data by Scholearn for the purpose of effecting introductions to Clients, for billing and fee collection purposes and to enable Scholearn to contact the Tutor from time to time. 10. Truthfulness and Accuracy
10.1 The Tutor warrants and represents to the Company that all written and oral statements and information provided by the Tutor to the Company for the purpose of or in connection with the tuition, including (but not limited to) personal information about the Tutor and/or your qualifications, credentials, references and suitability for providing the tuition were when provided, and remain, true, complete and accurate.
10.2 If anything occurs which materially changes the information originally provided, such as but not limited to, you being convicted of an offence or subsequent to your DBS check, you must inform the Company of this information in order that the information provided to the Company about yourself remains truthful and accurate.
